The plaintiff filed suit in the Philadelphia County Court of Common Pleas against premises defendants and several manufacturers of alleged asbestos-containing products. The plaintiff alleged that he developed mesothelioma from his exposure to asbestos fibers while on the premises. The plaintiff contended that his exposure to asbestos occurred from working around other trades on site. In his motion for summary judgment, Capriotti’s chief arguments centered around the misidentification of the premises in question along with plaintiff’s failure to establish regular and frequent exposure to any asbestos-containing products. Despite plaintiff’s arguments, summary judgment was granted.
